2.9. The buyer has the right to demand the correction, destruction of his personal data or the suspension, except for storage, of the processing of his personal data when the data is processed in violation of the provisions of the law.
2.10. The Data Controller recognizes and respects the right to privacy of every Buyer who registers in the online store AVIETE.eu (www.aviete.eu). The Data Controller collects and uses the Buyer's personal data (name or surname, address, phone number, e-mail address and other information specified in the registration form of the online store) for the processing of orders for goods or services or the fulfillment of other assumed contractual obligations. When placing an order or registering, the customer agrees to the rules for buying and selling goods, which 2.3. point states that by approving these rules, the Buyer agrees that the personal data provided by the Buyer will be processed for the purposes of selling goods and services in the AVIETE.eu online store, analyzing the Seller's activities and direct marketing. It also includes advertising and informational delivery messages, the registering Buyer agrees to receive newsletters and similar materials, which the Buyer has the full right to refuse.
2.11. The Data Controller undertakes not to disclose the Buyer's personal data to third parties, with the exception of the Data Controller's partners providing goods delivery or other services related to the proper fulfillment of the Buyer's order. In all other cases, the Buyer's personal data may be disclosed to third parties only in accordance with the procedure provided by the legal acts of the Republic of Lithuania.
2.12. Personal data is processed using secure means that protect this data from unauthorized destruction, disclosure or other illegal actions.
2.13. The data of individuals who have agreed to have their data used for direct marketing purposes are stored in an active database and used for 2 years for direct marketing purposes. Buyer data is stored for 2 years from the last purchase. After this term, customer data is (automatically) destroyed. Automatic destruction of personal data is supervised by a responsible person.
3. Buyer's rights and obligations

3.2. 4. Seller's rights and obligations

5.4.2. Payment by simple bank transfer is advance payment, when the Buyer makes a local payment order directly to MB "Liurasta" Luminor's bank account. The requisites for the order are provided before confirming the order, and are also indicated on advance and VAT invoices. A customer who does not use electronic banking can print the bill and make the order in his bank branch. The buyer must indicate the order number in the "Payment purpose" section of the payment form, which is provided in the order confirmation e-mail. in the letter. The fees applied by the bank for transferring money to the bank account of MB "Liurasta" Luminor are not included in the customer's bill for the goods. The seller is not responsible for the application and/or amount of such fees. Before making a bank transfer, make sure that you have confirmed the order and received a confirmation e-mail, otherwise the order will not be registered in the system. Attention! When paying in this way, funds are credited only to the standard e-mail you use. procedure of the banking provider (your bank), and transfers are credited only at certain intervals, on appropriate days. When paying in this way, the customer must be familiar with the duration and accuracy of the funds transfer in accordance with the regulations of the bank he uses, the seller is not responsible for the duration of crediting of funds in this case and the order execution begins only after the funds appear in the MB "Liurasta" Luminor bank account.
5.4.3. Payment in cash to the courier at the time of delivery - if the buyer chooses the service of delivery of goods by courier during the order, payment can also be made when picking up the goods at the courier who delivers them. 5.5. The buyer, who has chosen the services of payment by bank transfer, undertakes to pay for the goods immediately, because only after receiving the payment for the goods, the goods parcel begins to be formed and the deadline for sending the goods begins to be calculated.
5.6. The seller issues an electronic version of the invoice to the buyer, a version of the advance invoice, to the specified e-mail address. by mail, received immediately after order confirmation. The final invoice is issued after payment, the paper version of such an invoice is delivered together with the goods, the electronic version is sent by e-mail. by post
6. Delivery of goods
6.1. Depending on the shipping method selected, free shipping is also offered on purchases over a certain amount. Minimum free order amounts are listed in the shipping price table.
6.2. The price of standard home delivery throughout Lithuania (except Neringa municipality) is presented in the delivery price table. We deliver to homes both by DPD couriers and by Venipak couriers. The delivery price depends on the weight of the order. The order is delivered within 1-2 days. The store is not responsible if the delivery is delayed due to circumstances beyond our control (usually related to the work of courier services). When picking up the package in the store, you must have a personal identification document with you, the package is delivered only to the person whose name and surname are indicated in the order.
6.3. It is also delivered to Omniva post machines, DPD post machines, Itella post machines, LP Express post machines and Venipak post machines. Delivery prices are given in the delivery price table. The order is delivered within 1-4 days. Goods delivered to the post office are notified via SMS, so it is important to indicate the correct Lithuanian phone number. The parcel is stored in the postal machines for a limited number of calendar days. If it is not picked up on time and the parcel returns to the store, the buyer pays the price of returning the parcel (identical to the shipping price) and the cost of a new shipment.
6.4. The buyer, who has chosen the goods delivery service during the order, undertakes to indicate the exact place of delivery of the goods and the exact phone number.
6.5. The buyer undertakes to accept the goods himself. In the event that the Buyer cannot accept the goods himself, and the goods are delivered to the specified address, the Buyer has no right to make claims to the Seller regarding the delivery of the goods to the wrong entity.
6.6. All goods are delivered by DPD and Venipak services to the address specified in your order information.
6.7. Shipments via DPD couriers for customers are delivered on weekdays in three intervals for your convenience. Estimated delivery time is from 8am.
6.8. The Seller delivers the goods to the Buyer within 1-3 working days (depending on the chosen courier) or, if it is indicated that the goods are traveling directly from the supplier's warehouse, within 5-9 working days. If the item is listed as in stock, it will definitely be delivered within 1-3 business days. These deadlines are preliminary, but 99% of cases are delivered within 3 working days. At the same time, the Buyer agrees that in exceptional cases the delivery of the goods may be delayed due to unforeseen circumstances beyond the Seller's control. In this case, the Seller undertakes to immediately contact the Buyer and coordinate the terms of delivery of the goods. If you choose the service of delivery in the evening of the same working day, your goods will be delivered the same evening, if the order payment is received before 4 pm.
6.9. When delivering goods to the Curonian Spit, the price of delivery to Omniva's post machine is from €2.12. Other delivery methods - from €32.32, depending on the weight of the shipment. The rule of free delivery from €60 does not apply. Contact by phone or e-mail by mail, another delivery method and price can be agreed upon.
6.10. We deliver parcels not only in Lithuania, but also throughout Europe at separate rates.
6.11. The ordered goods are always delivered in one shipment, and the Buyer is informed individually about the delivery times of different goods. Multiple items ordered can be delivered in separate shipments at the customer's request for an additional standard delivery fee.
6.12. In all cases, the Seller is released from responsibility for the violation of the deadlines for the delivery of the goods, if the goods are not delivered to the Buyer or are delivered late due to the fault of the Buyer or due to circumstances beyond the Seller's control.
6.13. During the delivery of the goods, you must check the external condition of the package while the courier is present. Upon noticing even the slightest damage to the shipment, it is necessary to write down notes about the damage to the shipment or refuse to accept the shipment.
6.14. After receiving the shipment and signing the manifest without comments, it is considered that the shipment has been delivered in good quality, and in this case, claims for external damage to the product will no longer be accepted. In any case, the product warranty obligations remain valid.
6.15. In all cases, the Buyer must immediately inform the Seller if the shipment is delivered in damaged packaging, if the shipment contains unordered goods or the wrong amount of them, or if the goods are incomplete.
6.16. In all cases, if the buyer notices any damage to the package during delivery, he must indicate the comments in the package delivery document provided by the courier or draw up a separate document regarding these violations. The Buyer must do this in the presence of the courier. If such actions are not taken, the Seller is exempted from liability against the Buyer for product damage related to packaging damage, which the Buyer did not note in the delivery document of the courier.
7. Product quality and guarantees, warranty service

7.6.1. The warranty service form must be filled out and signed, real and valid data must be specified in the form. Claims are not accepted without specifying such data, filling in or signing the form.
7.6.2. The warranty service form must be properly sent to the customer service e-mail. email info@aviete.eu and wait for the service specialists to contact you (up to 2 days). In the subject of the e-mail, it is necessary to indicate "Warranty Service" and your four-digit order number, for example: Warranty Service 1234. The order number is provided on the invoice and in e-mails related to the order. in letters, short messages.
7.6.3. Delivery of goods for warranty service is carried out at the buyer's expense. Goods for warranty service are delivered by a courier ordered by AVIETE.eu. After the warranty service, an invoice is issued for delivery and transportation without payment, the repaired product is not returned to the buyer.
7.6.3.1. After ordering the warranty service, AVIETE.eu fills out all the necessary documents related to the transportation of the product. The customer does not need to fill out anything and additionally print, stick on packages, track. For additional reservations or problems, AVIETE.eu managers contact the customer personally.
7.6.3.2. The courier is called for the next working day after receiving the form. The courier usually informs about the arrival by phone, the customer must prepare and pack the goods before the arrival of the courier.
7.6.4. The buyer undertakes to properly and safely pack the transported goods. AVIETE.eu does not assume responsibility for damage caused during transportation of improperly packed goods returned for warranty service.
7.7. The warranty service is performed by an authorized AVIETE.eu service center, the warranty check is performed within 10 working days after receiving the warranty goods for repair.
7.8. Warranty repair is carried out up to two weeks (ten working days), but in the event of unforeseen circumstances, when importing the necessary parts from the manufacturer, the warranty repair may last longer, informing the customer about this.
7.8. The manufacturer's warranty does not apply to natural wear parts.
7.9. If the product is found to have a non-warranty defect, caused by the user's fault and/or improper use, the parts required to repair the defect and additional work shall be paid for by the customer. The client is informed about the payment and any work performed for money is carried out only at the request and consent of the client. An invoice is issued for such work, if not paid, the repaired product is not returned to the customer.
7.9.1. If the product is found to have a non-warranty defect, caused by the user's fault and/or improper use, and the Buyer refuses a chargeable repair, the cost of returning the goods shall be paid by the Buyer.
7.10. If the product is found to have a major failure, damage due to a manufacturer's error, a manufacturer's defect or any other quality discrepancy that requires repair by the manufacturer - the product is immediately replaced by a new one for the customer, regardless of how long the product has been used, if the warranty service period is valid.
7.11. The customer always has the right to contact AVIETE.eu and we will try to provide prompt assistance or necessary information regarding product repair. When applying, please indicate the order number, date of purchase, buyer's name, surname or company name.
7.12. If the product is of poor quality, you can return or exchange the product within 14 calendar days from the day of purchase (receipt of the product) in accordance with Chapter 8 of these rules.
8. Return and exchange of goods and/or money
If you want to cancel an order for which you have not yet received the goods, or refuse a certain item(s) from an order that has not yet been fulfilled, but paid for, and get your money back, please contact us at info@aviete.eu. Otherwise, please follow the rules below:
8.1. The defects of the sold goods are removed, low-quality goods are exchanged, returned in accordance with Article 6.228 of the Civil Code, except for the cases specified in Article 10, Part 2 of the Civil Code 6.228. In all cases, money for returned goods is transferred only to the bank account from which the goods were paid for.
8.2. In order to return the item(s) based on Rule 8.1. point, the Buyer can do this within 14 (fourteen) calendar days from the day of delivery of the goods to the Buyer, by filling out and sending the goods return form to the Seller. You can find this form by logging in to your account in the Product returns section or by filling out the Omniva return form https://grazinimai.omniva.lt/pardotuves/aviete-eu, if you wish to make the return via Omniva post machines (in this case, follow section 8a.).
8.2.1. The product return form must be filled out and signed, and real and valid data must be provided in the form. Claims are not accepted without specifying such data, filling in or signing the form.
8.2.2. The product return form must be properly sent to the customer service e-mail. email info@aviete.eu and wait for the service specialists to contact you (up to 2 days). In the subject of the e-mail, it is necessary to indicate "Return of goods" and your four-digit order number, for example: Return of goods 1234. The order number is provided on the invoice and in the e-mails related to the order. in letters, short messages.
8.2.3. Money is returned to the bank account no later than within 10 working days, this term is calculated from the day the goods are returned to the warehouse.
8.2.4. Return and/or exchange of defective goods is free of charge. Quality goods are returned at the buyer's expense. The condition of the returned goods is checked by the warranty service, if the returned goods are of good quality, the standard fee for returning goods in Lithuania is deducted from the returned amount (€3.50, if the goods are returned via Omniva post machines and €7.00, if the parcel is returned by handing over the parcel to a courier called by Aviete.eu to home).
8.2.5. After ordering warranty service, AVIETE.eu fills in all the necessary documents related to the transportation of the goods. The customer does not need to fill out anything and additionally print, stick on packages, track. For additional reservations or problems, AVIETE.eu managers contact the customer personally.
8.2.6. The courier is called for the next working day after receiving the form. The courier usually informs about the arrival by phone, the customer must prepare and pack the goods before the arrival of the courier.
8.2.7. The buyer undertakes to properly and safely pack the transported goods. AVIETE.eu is not responsible for damage caused during transportation of improperly packed returned goods.
8.3. When returning goods to the buyer, it is necessary to comply with the following conditions:
8.3.1. The returned item must be in its original, neat packaging;
8.3.2. The product must be undamaged by the Buyer;
8.3.3. The product must be unused, without losing its appearance as a product (label intact, protective film not torn, etc.) (this clause does not apply in the case of returning a defective product);
8.3.4. The returned product must be in the same configuration as the Buyer received it;
8.3.5. When returning the product, it is necessary to present the document of its purchase.
8.4. The Seller has the right not to accept the goods returned by the Buyer if the Buyer does not comply with 8.3. the procedures for returning goods set out in point
8.5. When returning the wrong product and/or low-quality product, the Seller undertakes to pay for their return and replace them with similar, suitable products.
8.6. In the event that the Seller does not have goods suitable for replacement, the amount paid will be returned to the Buyer within 10 working days, excluding the cost of delivery.
8.7. AVIETE.eu unilaterally has the right to deduct from the amount returned to the customer the amount of the additional discount, if the customer used the additional discount of the offer, as well as the difference in the delivery price fee from the cheapest delivery method.
8.8. In the event that the reason for the return of the product is inadequate quality, AVIETE.eu undertakes to replace the product of inadequate quality with a product of adequate quality at its own expense or to return the money paid for the product. Goods of inappropriate quality are exchanged or returned in accordance with Art. 6.228 of CC 10.
8.9. If, during the warranty period, a product of inadequate quality purchased by the customer is replaced by a new product of adequate quality, the remaining warranty period applies to the replaced product, i.e. the warranty period is not extended.
8.10. IMPORTANT! The procedure for returning goods does not apply to: quality food products, legal entities, products with individual customer changes, according to wishes, individual orders (for example, printing) that damage their original merchandise appearance irreversibly, individually ordered goods, goods that have been damaged by the customer, goods that do not meet the return standards listed above (damaged merchandise appearance, with signs of use, wear and tear), for goods to be returned after the 14-day return period, an exception applies to goods that do not meet the return requirements, but of poor quality.
8a. How to return shipments from the Avieta store through Omniva post machines?

9. Liability of buyer and seller
9.1. The Buyer is fully responsible for the correctness of the personal data provided by the Buyer. If the Buyer does not provide accurate personal data in the registration form, the Seller is not responsible for the resulting consequences and acquires the right to demand compensation for the direct losses suffered by the Buyer.
9.2. The buyer is responsible for the actions performed using the AVIETE.eu e-mail. in the store.
9.3. After registering, the Buyer is responsible for transferring his login data to third parties. If AVIETE.eu e-mail the services provided by the store are used by a third person who is connected to this e-mail. store using the Buyer's login data, the Seller considers this person as the Buyer.
9.4. The Seller is released from any responsibility in cases where losses arise because the Buyer, regardless of the Seller's recommendations and the Buyer's obligations, did not familiarize himself with these Rules, although he was given such an opportunity.
9.5. 11. Final Provisions
